Article 1 Definitions

In these general terms and conditions, the following definitions apply:

Entrepreneur: Kbeautycare, established in Capelle aan den IJssel, registered with the Chamber of Commerce under number 94894655.

Consumer: Any natural person who is not acting in the exercise of a profession or business and who enters into an agreement with the entrepreneur.

Agreement: Any agreement between the entrepreneur and the consumer regarding the purchase of products via www.kbeautycare.nl.

Products: All goods offered by Kbeautycare, including skincare products and related items.

Website: The official online store of the entrepreneur: www.kbeautycare.nl.

Article 2 Applicability

These general terms and conditions apply to every offer made by Kbeautycare and to every distance agreement concluded between Kbeautycare and the consumer. By placing an order, the consumer accepts these terms and conditions. Deviations are only valid if agreed upon in writing.

Article 3 Offers and Prices

All offers listed on the website are without obligation and subject to availability. Prices are stated in euros, including VAT and excluding any shipping costs. Price changes do not affect orders that have already been placed and confirmed.

Article 4 Orders and Delivery

Orders are placed via www.kbeautycare.nl. After placing an order, the consumer will receive an order confirmation by email. The entrepreneur aims to deliver within the timeframe stated on the website. Exceeding the delivery time does not entitle the consumer to compensation, unless otherwise required by law. Delivery takes place at the address provided by the consumer.

Article 5 Payment

Payment is made using the payment methods offered on the website, such as iDEAL and credit card. If a payment is refused or fails, the order will not be processed.

Article 6 Right of Withdrawal

• The consumer has the right to withdraw from the agreement within 14 days after receiving the product, without stating reasons.
• During this period, the consumer must handle the product and packaging with care. The product may only be unpacked or used to the extent necessary to assess its nature, characteristics, and functioning.
• To exercise the right of withdrawal, the consumer must inform the entrepreneur in writing or by email.
• After withdrawal, the product must be returned within 14 days in its original condition and packaging.
• Both shipping costs and return costs are entirely at the consumer’s expense.
• If the product is returned unused, unopened, and in original condition, the purchase amount excluding shipping costs will be refunded within 14 days after receipt of the withdrawal notification.
• If the order was part of a promotion in which the consumer received a free product, sample, or gift, this item must also be returned unused and in good condition if the return causes the order to no longer meet the promotion conditions.
• If the free gift or sample is not returned or is damaged, the entrepreneur reserves the right to deduct the value of the gift from the refund amount.

Article 7 Exceptions to the Right of Withdrawal

Hygiene products whose seal has been broken after delivery cannot be returned.

Article 8 Warranty and Complaints

The entrepreneur guarantees that the products comply with the agreement and meet reasonable expectations of quality and usability.

Complaints must be reported as soon as possible after discovery and no later than 14 days via info@kbeautycare.eu. Complaints will be substantively addressed within 14 days.

Article 9 Liability

The entrepreneur is not liable for damage resulting from incorrect use of the products. Liability is limited to the purchase price of the relevant product, unless there is intent or gross negligence.

Article 10 Privacy

Personal data is processed in accordance with the General Data Protection Regulation. More information can be found in our privacy policy at www.kbeautycare.nl.

Article 11 Disputes and Applicable Law

Dutch law applies exclusively to all agreements between the consumer and the entrepreneur. Disputes may be submitted to the competent court in the district where the consumer resides.

Article 12 Product Disclaimer

Kbeautycare products are intended for skincare purposes and are not a substitute for medical treatment. If there is any doubt about the suitability of a product, it is recommended to consult a doctor or skincare professional.

Article 13 Final Provisions

If any provision of these terms and conditions is declared invalid, the remaining provisions shall remain fully in force. In such cases, the parties shall agree on a new provision that most closely reflects the original intent.
